Recent trends in investment arbitration and arbitrations between private parties and state entities.
The decisions taken by Russia to expropriate foreign companies’ assets has given rise to a number of questions also in relation to arbitrations against Russia. Further, the viability of intra-EU investor-state arbitration has been a hot topic for debate, particularly in light of states’ continued exodus from the Energy Charter Treaty and a recent decision from Germany’s Federal Court of Justice finding that parties could request a German court to declare an intra-EU ICSID arbitration incompatible with EU law before proceedings even commenced.
The arbitration between a mining company on the one side and Denmark and Greenland on the other side
In terms of the arbitration proceedings between a mining company on the one side and Denmark and Greenland on the other, the proceedings follow a ban on uranium extraction by Greenland’s newly elected government in 2021. The case turns on whether the Greenlandic Act banning uranium is contrary to an exploration license from 2007, including whether the Uranium Act terminates the mining company’s alleged vested rights over the exploitation of rare earths, as opposed to uranium. The case is not an investment arbitration as such, but the parties rely on arguments drawing on international law and investment treaty case law.
